Why Clear Insurance Regulations Matter_ Protecting Policyholders in Colorado and Beyond

Most policyholders rarely read the fine print of their insurance policies until disaster strikes. When a claim is filed, whether after a hailstorm, fire, or auto accident, many consumers find themselves overwhelmed by unfamiliar language, complex procedures, and a process that seems stacked against them.

This lack of knowledge isn’t rare. A 2023 survey found that only 26% of Americans could correctly explain the details of their homeowners or auto insurance policies. Even fewer understood how to obtain a certified copy of their policy during a claim. Without access to clear policy language and representation, many consumers are left at a significant disadvantage when negotiating with powerful insurance companies.

Why the Language of Regulations Matters

Regulations like Colorado’s 3 CCR 702-5 directly shape how insurers and policyholders interact. These rules determine who can request policy information, how long insurers have to respond, and the channels through which requests must be made. Seemingly small details in the wording can make the difference between a fair process and one that leaves policyholders stuck in limbo.

For example, in the recent draft of 3 CCR 702-5, the regulation would allow claimants or their attorneys to request a certified copy of a policy. But it left out Public Adjusters, who are often the licensed representatives advocating on behalf of policyholders. Without this inclusion, thousands of policyholders could be denied critical access to their own insurance information simply because their chosen representative wasn’t listed.

Another proposed requirement would have forced consumers to route requests through a company’s registered agent—a technical and often confusing legal designation. For most policyholders, this is a term they’ve never heard before, creating unnecessary barriers to accessing documents that should be readily available.

AAA’s Role in Protecting Policyholders

That’s where the American Adjuster Association (AAA) steps in. Our mission is to level the playing field between policyholders and insurance companies. We carefully review proposed laws and regulations across the country to ensure that consumer rights remain front and center.

In this instance, AAA submitted formal comments to the Colorado Division of Insurance (DORA) urging them to amend the regulation so that:

  • Public Adjusters are included as authorized representatives alongside attorneys. 
  • Requests can be made through normal communication channels such as the policyholder’s agent, the insurer’s adjuster, or legal counsel—not just through a registered agent. 

By advocating for these changes, AAA is working to ensure that every policyholder has fair access to their insurance policy and a meaningful opportunity to use the coverage they’ve paid for.

The Bigger Picture

Insurance affects nearly every household in America, yet it remains one of the least understood industries. When regulations are written without considering the real-life experiences of consumers, they risk creating red tape that benefits insurers at the expense of families and small businesses.
